GENERAL TERMS AND CONDITIONS
The terms below supercede any terms of a previous agreement with Tenancy Practice Service Ltd.
The resources provided through the service are subject to copyright. The material found within the TPS Portal must not be replicated, copied or used within a competitor system.
This agreement is a fixed term contract. Your subscription to any associated services and discounts is for a minimum term of 12 months, this agreement will continue for the duration of that term. If you terminate this agreement before the minimum 12 month term, you agree to pay an early termination charge of the balance owing to the end of the term. Selling of the business or rent roll does not release you from the term of the contract. Tenancy Practice Service Ltd reserves the right to terminate this agreement on 48 hours’ notice.
If for any reason there is a debt owed for unpaid subscription fees you agree to pay all costs associated with collection of those fees, including but not restricted to debt collection fees, court fees and lawyer fees.
I understand that if another office, branch or company uses my login information that the monthly charge will increase to reflect the number of offices in my group.
We cannot guarantee that our Services will always operate free of faults or that our Services will operate free of viruses or other harmful programmes or disabling features.
Ending your subscription
After the initial term, one calendar months’ notice is required to end your subscription, the one month period will start on the last day of the month we are notified of the request to end your subscription, notification must be by email or in writing. When the subscription has ended all software licenses will be cancelled resulting in no access to Total Tenancy or any other service, products or discounts associated with the Total Tenancy subscription.
PARTNERS TERMS AND CONDITIONS
“Elite Partners” can only display the “Elite Partner” logo in their marketing during the term of the agreement. If the agreement is terminated by either party, I agree to remove the “Elite Partner” logo from all marketing.
By becoming an Elite Partner you consent that the name, email and phone number of users from your company will be added to the Elite Partner Directory. This will include company, name, email, phone. Users can log in to their directory account and update their information and can delete their directory listing by contacting email@example.com. In giving this consent you agree that you have the consent of your users to do this.
We reserve the right to display our top performing clients in terms of compliance on our website for owners to see, and to inform the market of this via email or other communication. This information is based on an algorithm relating to the amount of properties that have been assessed, total number of properties that are compliant, the total number of partly compliant properties and the total number of properties as well as other variables.
“Business Partners” can only display the “Business Partner” logo in their marketing during the term of the agreement. If the agreement is terminated by either party, I agree to remove the “Business Partner” logo from all marketing.

Paying your bill
The subscription is to be paid monthly on invoice. Failure to pay any invoice on the due date may result in a late payment fee and your subscription being suspended.
I agree that all users have been made aware that they must have written authority from the applicant to run a background check and credit check.
I warrant that all applicants have signed an appropriate waiver allowing the use of this background and credit checking system.
I warrant that all users of the system will be trained to use the system and they understand their legal requirements under the Privacy Act.
I agree that if I background check an applicants’ references or previous landlords or contacts, I will not tick the PPSR box.
eBUNDLE PRO TERMS AND CONDITIONS
I understand that the tenancy application and agreement and the clauses and provisions are all subject to copyright of the Tenancy Practice Service LTD.
I agree not to copy and paste any content into other tenancy application or agreements systems.
I authorise Tenancy Practice Service LTD to contact our developer on my behalf to instruct them to implement the integration selected above.
I authorise Tenancy Practice Service LTD to retrieve my API username and password.
I understand if I cancel my eBundle Pro subscription, I will no longer be a Business or Elite Partner. Re-subscribing may incur a sign-up fee.
If you are using the Tenancy Agreement, which creates leads for MovingHub, at the discretion of Tenancy Practice Service LTD, we may waive the monthly fee for accessing eBundle Pro.
I understand I must not use the eBundle system in conjunction with a competitor product.
Tenancy application data will be automatically archived after one month from when a tenant applies if no credit check has been run and no tenancy agreement has been created. Tenancy applications that have been archived that are older than one month and have had a credit check or background check run against them will also be deleted.
TOTAL TENANCY TERMS AND CONDITIONS
The cost of Total Tenancy Pro is currently $95+gst per month, and Total Tenancy Expert is currently $135+gst per month. This cost is guaranteed not to increase during your first year and may be revised after the first year dependant on additional services, training, and resources, added to Total Tenancy.
