U-turn on Property Managment Regulation

After shelving the idea just two years ago, the Government has effectively made a quiet U-turn on regulating residential property managers.

This time opting for a “light-touch” model rather than full licensing.

Associate Minister of Housing Tama Potaka said the goal is balance.

“The changes are designed to improve consistency and accountability across the rental sector, while keeping compliance simple and practical,” he said. 

The proposed regime introduces compulsory registration for property managers and organisations, with key requirements including: minimum age (18+), education or experience standards, ongoing professional development, and renewal of registration every two years.

Property managers must follow a code of conduct, keep records for seven years, and ensure all client funds are held in separate trust-style accounts.

A new Regulatory Authority, Registrar, and Disciplinary Tribunal will oversee complaints and enforcement.

While private landlords remain out of scope, the move signals a clear shift, acknowledging that baseline regulation is now necessary to lift standards without overburdening the industry.

Timing for commencement remains uncertain, with legislation yet to be introduced and subject to the Government’s legislative priorities and Parliamentary process.
