One District Court decision reshaped how tenancy termination applications are assessed in New Zealand.

Vincent Dean Huff’s case began with allegations that he had refused lawful access to the rental property, but the appeal became about something much bigger: when does a breach actually justify ending a tenancy?

The Court made it clear that termination is never automatic. Instead, the Tribunal must weigh the tenancy’s history, the seriousness of the breach, future compliance, whether ending the tenancy is a fair outcome to name just a few factors.

Those principles are now known as the “Huff factors” and have been applied in more than 160 published Tenancy Tribunal decisions online.
